A violation of personal and property rights, including the right to one's own image, is recognized only when one person deliberately photographs or films another, making them the primary subject of the recording. This was reported to Tatar‑inform by lawyer Alexander Khaminsky.
"If the purpose of the photograph is to capture a premises or an event, and another person accidentally appears in the frame while not being the main subject of the shot, then their personal and property rights are not violated at that moment," the lawyer explained.
He noted that if a person accidentally appears in a close-up in the frame at a public event, for example at a football match, such filming is also not a violation. The same, he said, applies to video recording.
"For example, if at a concert you film an overly emotional person, post that video online and comment on their behavior, that will be considered a violation of personal and property rights. If, however, a person films an overview video that merely records people's reactions to the performance of their favorite artist, there is nothing illegal in that," Khaminsky concluded.
