      The Belgian depository Euroclear has changed the rules for unblocking the assets of Russian investors. The process is now possible without a license from the US Office of Foreign Assets Control (OFAC). This was reported by a large broker that handles asset unfreezing. According to Gleb Boyko, a sanctions law and compliance lawyer at the NSP law firm, three cases of successful asset unblocking in different brokerage companies are already known. The new mechanism was agreed with Euroclear about a month and a half ago. Boyko notes that previously the European depository did not apply such a practice.

      Delcredere’s lawyers reported on their Telegram channel that they received a letter from Euroclear with the new course of action. Asset unblocking is possible under the following conditions:

      - no American persons or financial institutions participate in the transaction;

      - the movement of assets occurs only within Euroclear;

      - the investor has a license from the Belgian Treasury.

      Irina Rotachkova, head of the asset unblocking division at BGP Litigation, said that her law firm is handling several such cases, but none have been completed yet.

      Recall that at the end of February – beginning of March 2022 the European depositories Euroclear and Clearstream ceased cooperation with the Russian National Settlement Depository (NSD). Assets were frozen in the summer of 2022 after the European Union imposed sanctions. In the summer of 2024 the United States imposed sanctions on the Moscow Exchange group, after which unfreezing assets required obtaining two licenses — from the EU and OFAC. However, in September RBC Investments found that the process had stalled because OFAC does not issue licenses to Russians.
