The government commission on legislative activities will consider on March 23 a draft amendment to the law on cash register equipment (KKT), aimed at strengthening control over the use of online cash registers. The document was developed by the Ministry of Finance of the Russian Federation as part of a plan to whitewash the economy, reports "Kommersant". Among the key proposals is the creation of a registry of systematic violators, which will be maintained by the Federal Tax Service. Those who deliberately evade the use of online cash registers will be included in it: after at least two cases of being held accountable for the absence of KKT within a year, or if the number of such cases in a year constitutes 20% of the number of registered cash registers (but not less than two). Exclusion from the registry is possible in the absence of new violations for three months. Being in the registry will impose bans on selling goods online – if violated, the websites of offenders will be blocked out of court. Systematic violators will also be unable to rent premises in large shopping centers with an area of over 3,000 square meters with at least ten tenants. The owners of such properties are obliged to check the presence of registered KKT with tenants and their absence from the registry; otherwise, the lease agreement will have to be terminated. Furthermore, it is planned to strengthen control over the accounting of revenue received from cashless payments. Currently, part of the income may not be recorded at the cash register and not declared. According to the Central Bank for 2024, the gap between the volume of revenue from cashless payments and the information reflected in receipts amounted to almost 4.5 trillion rubles, with about a third of this amount not being declared. In this regard, the draft law requires banks to provide the Federal Tax Service with information on cashless payments made by customers with individual entrepreneurs or legal entities, and for customers themselves to receive cash register receipts from the tax service. The receipt must reflect the identifier of the cashless payment. The Ministry of Finance explained that this approach could ensure about 100 billion rubles in tax revenues over three years. Experts note that the new measures will make it virtually impossible to conceal cashless revenue and will lead to the disappearance of shadow points in large trading facilities. Honest businesses will receive more equal competitive conditions. At the same time, lawyers believe it is important for the criteria for inclusion in the registry and the procedure for exclusion from it to work carefully; otherwise, ordinary entrepreneurs may come under pressure. Specialists also suggest making the registry accessible to consumers.
