Residents of Tatarstan will be able to appeal the suspension of the registration of rights in out-of-court proceedings.
From the beginning of 2026, residents of Tatarstan will be able to appeal decisions to suspend the registration of property rights in an out-of-court procedure. This was reported by the press service of the Rosreestr Directorate for the Republic of Tatarstan.
Previously, the out-of-court appeal procedure applied only to decisions to suspend cadastral registration and to the simultaneous registration of rights and cadastral registration.
The law No. 207-FZ, which expanded Russians’ rights, was adopted on July 22, 2024. To ensure the out-of-court appeal procedure, a regional appeals commission will be created under the Rosreestr Directorate for Tatarstan.
“Previously the out-of-court appeal procedure was applied exclusively to decisions to suspend cadastral registration, whereas there was no such possibility for decisions to suspend the registration of rights. The introduction of this procedure seems justified, as it will make it possible, from January 1, 2026, to resolve some disputed issues related both to cadastral registration and to the registration of rights in an out-of-court manner. It is also expected to help reduce the burden on the judicial system,” commented Radik Shaykhraziyev, head of the legal support department of the Rosreestr Directorate for the Republic of Tatarstan.
The commission will include three representatives from the authority responsible for the registration of rights and three representatives from the national association of self-regulatory organizations of cadastral engineers, who will rotate once every five years.
Meetings of the new body will be held both in person and with remote participation. Applicants themselves, state registrars of rights who made the contested decisions, and other persons will be able to attend.
When considering appeals, the appeals commission will assess the justification for adopting the decision to suspend and, if necessary, request additional documents and materials.
An appeal must be submitted within 15 working days from the date the decision to suspend was made. The appeal is filed with the appeals commission at the location of the authority that made the decision to suspend. In Tatarstan this is the Rosreestr Directorate for the Republic of Tatarstan (Kazan, 74 Avangardnaya St.). An appeal can be submitted either in paper form or electronically — through the unified public services portal (Gosuslugi).
The appeal must include information about the applicant and information about the cadastral engineer who prepared the cadastral boundary plan, technical plan or inspection report that was previously submitted for cadastral registration or for the registration of rights.
In addition, the following will be required: the date and number of the application on the basis of which the decision to suspend was made, the date and number of the suspension notice itself, and a justification explaining why the applicant disagrees with that decision.
The appeals commission must make a decision to reject or grant the appeal no later than 15 working days from the date of its registration. The verdict will be delivered by open vote, by a majority of the votes of the commission members present at the meeting.
A corresponding form of the appeal, as well as a list of documents required to submit the said appeal, are provided. The appeal form and other reference information on the work of the appeals commission are posted on the Rosreestr Tatarstan website, rosreestr.tatarstan.ru, in the “Appeals Commission” subsection.
