Shurale returned to the people: court confirmed the inadmissibility of privatizing Tatarstan's fairy-tale character
The Intellectual Property Court (IPC) in Moscow upheld the decision of the Tatarstan FAS, which pointed to the unfair practices of LLC "National Toys."
The company that registered the "Shurale" trademark and demanded compensation for the use of this character was accused of attempting to appropriate a national symbol for financial gain.
The registration of one of the main characters of Tatar folklore, the forest spirit from the works of Gabdulla Tukay and folk tales, was deemed by the Tatarstan FAS to be an act of unfair competition that threatens not only the national cultural heritage of the Republic of Tatarstan but also a factor hindering the development of the creative industries.
"The protection of the character takes on special significance in light of news about the creation, on the basis of the old TsUM building, of a Center for Folk Arts, Crafts and Masters," noted the Tatarstan FAS. "The image of Shurale, as one of the main national heroes, in this space should freely inspire artists and craftsmen, and not be monopolized by a commercial entity acting solely in its own interests."
In its decision the antimonopoly authority emphasized that the image of Shurale is the heritage of the republic's people and lies outside the sphere of private ownership.
"The actions of 'National Toys' indicate an intent to obtain financial gain by prohibiting the use of trademarks registered by the company and claiming compensation for their use," commented the Tatarstan FAS. "The attempt to privatize a national symbol could have caused serious damage to the region's cultural space and limited the ability to create works of art, souvenir products and other projects featuring the image of Shurale."
The Intellectual Property Court agreed with the decision of the Tatarstan FAS of Russia and recognized the actions of LLC "National Toys" as unfair competition.
