Experts from the Federal Service for State Registration, Cadastre and Cartography for the Republic of Tatarstan conducted another training session for employees of the Multifunctional Center (MFC). During the meeting, specialists were informed about changes in legislation in the field of real estate and provided recommendations for accepting documents for the registration of rights and cadastral accounting, the agency's press service reports. Special attention was paid by the agency representatives to the necessity of indicating information about protective zones on land plots in purchase and sale agreements. Acting Head of the State Registration of Real Estate Department, Svetlana Potapova, explained that zones with special usage conditions are established both for the protection of objects—such as water bodies, rivers, historical and cultural monuments—and for protection against sources of negative impact, such as industrial enterprises. According to her, there are 28 types of such zones, including water protection areas, cultural heritage sites, gas and pipeline zones, energy sectors, and areas near airports. The Unified State Register of Real Estate currently contains information about almost 110,000 such zones in Tatarstan. Potapova noted that the presence of a protective zone does not prohibit transactions with the plots: the land can be sold or gifted, but the owner must consider the usage restrictions. For example, construction is prohibited at a certain distance from a gas pipeline. She also emphasized that the seller is obliged to inform the buyer about encumbrances and restrictions. Otherwise, the buyer has the right to demand a price reduction or termination of the contract with compensation for losses. Therefore, before purchasing real estate, it is important to check whether the plot falls within a protective zone and what restrictions apply. This information can be obtained in several ways: by requesting an extract from the Unified State Register of Real Estate (EGRN), studying the cadastral plan of the area, or using the public cadastral map on the NSPD platform. The issue of real estate registration in a protective zone is resolved on an individual basis. To formalize ownership rights, it is necessary to provide approval from the organization in whose interests the restriction is established. Thus, in the presence of a protective zone for power networks, one should contact the "Network Company," and for restrictions related to gas distribution networks, one should contact "Gazprom Transgaz Kazan." With such approval, the Rosreestr will register the object.
The agency reminded that violations in protective zones entail civil, administrative, and criminal liability. In particular, if buildings are erected in violation of the established distances from gas pipelines, they may be required to be demolished at the owner's expense.
