The only housing in bankruptcy: new order in the Republic of Tatarstan
In Tatarstan, the approach to the implementation of the only housing for bankrupt citizens may change. Serious amendments are being prepared to the legislation on bankruptcy of citizens. The draft federal law, approved by the Ministry of Justice of Tatarstan, changes the approach to the main property of debtors — their only housing.
What changes under the new law
Currently, the only housing of a bankrupt citizen is protected from seizure. Creditors cannot take it, even if it is a luxurious mansion. The new draft law introduces an exception: the only housing can be sold if its characteristics clearly exceed what is reasonably sufficient to meet the housing needs.
Criteria for assessing excessive housing
When deciding on the sale, several factors will be taken into account:
- total and living area of the premises;
- location and prestige of the area;
- structural features of the building;
- level of finishing and artistic design;
- quality of infrastructure around;
- technical equipment of the house.
Substitute housing for the debtor
The main condition for the sale is the acquisition of another housing for the debtor. It must be located in the same locality and area. The substitute apartment must comply with housing legislation requirements and ensure the preservation of a decent standard of living for the debtor and their family. The location of children's schools, the debtor's workplace, and the special needs of family members are also taken into account.
Debtor's rights during the sale
The debtor has the right to participate in the selection of substitute housing. The financial manager cannot terminate the ownership of the old apartment until the new housing is acquired. This is an important guarantee for the bankrupt's family.
When housing will remain with the debtor
The draft law provides for a protective mechanism. If the sale of excessive housing through public offering does not yield a sum sufficient to acquire substitute housing and significantly pay off debts, the housing will remain with the debtor.
Balance of interests
These changes aim to establish a fair balance. On one hand, the interests of creditors are taken into account, allowing them to recover part of the funds. On the other hand, decent housing conditions are preserved for citizens who find themselves in a difficult financial situation.
