Unaccounted documents and a serious diagnosis: how justice was restored for the conscript

      The Commissioner for Human Rights in the Republic of Tatarstan, Sariya Saburskaya, spoke about the assistance in reviewing the decision of the conscription commission regarding a conscript. The appeal was received through the Unified State Information System "GLONASS+112" from citizen K., who requested help in reviewing the decision of the conscription commission concerning the determination of her son's fitness category for military service. The applicant indicated that the young man was diagnosed with a congenital heart defect and a second-degree bicuspid aortic valve; however, not all supporting medical documents were considered by the therapist during the medical examination. Sariya Saburskaya promptly forwarded the appeal to the Military Commissariat of the Republic of Tatarstan, requesting verification of the arguments and necessary actions. As a result of the work carried out, the decision of the conscription commission of the district military enlistment office was canceled based on paragraph 3 of article 29 and the fifth paragraph of paragraph 1 of article 28 of the Federal Law "On Military Duty and Military Service." Following a repeated medical examination, in accordance with article 42, paragraph "b" of column I of the Schedule of Diseases, the conscript was assigned a fitness category of "B" (limited fit for military service), and as a result, he was exempted from conscription.
