The State Council of the Republic of Tatarstan approved a bill regulating the handling of stray animals.

      Deputies at the 17th session of the State Council of the Republic of Tatarstan today approved a bill regulating the handling of stray animals. The document introduces amendments to the law “On the Regulation of Certain Issues in the Field of Animal Handling in the Republic of Tatarstan.”

      As deputy Nazip Khazipov reported, the bill proposes to grant the Cabinet of Ministers of the Republic of Tatarstan a number of powers. In particular, the government will be able to determine the criteria by which a situation in the republic is recognized as extraordinary in the field of handling stray animals, approve the procedure for introducing the regime of such a situation and the list of measures to resolve it, and also establish the rules for the operation of temporary animal holding facilities.

      According to the bill, the decision to introduce the regime of an extraordinary situation will be made by the Main Directorate of Veterinary Medicine under the Cabinet of Ministers of the Republic of Tatarstan. The agency is also responsible for carrying out measures to eliminate such situations.

      Deputy Khazipov noted that the law is planned to be supplemented with an article listing actions related to dealing with homeless animals on the territory of the republic.

      In addition, the document provides for an article regulating cases of euthanasia of ownerless animals held in temporary holding facilities. Such a measure will be applied in several cases:

      - to end unbearable physical suffering of animals unable to survive. The presence of an incurable disease or injury must be confirmed by a veterinarian;

      - in cases of infectious diseases or diseases dangerous to humans and other animals, confirmed by a veterinarian;

      - in cases of unmotivated aggression by homeless animals and their attacks on people.

      The article also provides for the implementation of measures to resolve extraordinary situations in the field of handling ownerless animals on the territory of Tatarstan. The main provisions of the regime of such a situation will be enshrined in a separate new article of the law.

      The bill was developed taking into account the federal law on responsible treatment of animals and the ruling of the Constitutional Court of the Russian Federation in the case on checking the constitutionality of certain articles of the law, initiated by the Supreme Court of Buryatia, according to the explanatory note to the document.

      According to the federal law, euthanasia of animals kept in shelters is prohibited. An exception is allowed only to end unbearable physical suffering of animals incapable of surviving; the presence of an incurable disease or injury must be confirmed by a veterinarian, who is obliged to carry out the procedure humanely, ensuring a quick and painless death.

      The ruling of the Constitutional Court of the Russian Federation expands this list: euthanasia is permitted if an ownerless animal attacked a person, displays unmotivated aggression, or is a carrier of a dangerous disease.

      In addition, euthanasia is allowed in conditions of an extraordinary situation in the region, when it is necessary to protect people from attacks by stray animals or from the spread of diseases dangerous to humans. The owner is in this case given a reasonable period and the opportunity to find the lost pet.

      Similar norms are in force in the legislation of Murmansk, Astrakhan, Orenburg, Kemerovo, Amur and Magadan oblasts, the Jewish Autonomous Oblast, as well as in the republics of Chuvashia, Tyva, Khakassia, Buryatia, Sakha, and in Zabaykalsky and Stavropol Krais.
