From March 1, 2025: new rules for the development of land plots — what property owners need to know
From March 1, 2025, a federal law regulating the procedure for developing land plots intended for individual housing construction (IHC) and gardening comes into force.
The corresponding announcement was published by the Ministry of Land and Property Relations of the Republic of Tatarstan.
Key requirements of the law
The new regulatory act establishes strict deadlines and a list of mandatory measures for landowners. Key provisions:
Development deadline — 3 years from the moment of acquiring rights to the land.
Mandatory development measures include:
- leveling the terrain;
- stump removal;
- drainage;
- clearing of weeds and other tasks.
Criteria for non-use of land plots
The law clearly defines signs by which a plot may be declared unused:
- For plots intended for construction — absence of a built and properly documented building for 5 years.
- For IHC plots — absence of a constructed and registered house for 7 years.
- For garden and allotment plots — overgrowth by weeds taller than 1 m over more than 50% of the area one year after the violation is recorded.
- For all types of plots — littering or contamination by waste over more than 50% of the area.
- If there are structures — their destruction (damage to the roof, walls, windows) without the start of restoration works within one year.
Control and consequences of violations
Detection of violations will be carried out by:
- Rosreestr;
- local self-government bodies.
If the fact of non-use is confirmed, the plot may be seized. In this case the former owner will be returned the funds from the sale of the plot, minus the expenses for conducting the auction.
Position of the ministry
Deputy Minister of Land and Property Relations of the RT Almaz Kiyamov emphasized that the aim of the law is not to withdraw plots from private ownership, but to stimulate owners to actively use the land: “The state has no and never had the objective of withdrawing a plot from private ownership. The main goal is to stimulate citizens to return to the land plots they have abandoned and decide their fate, as prescribed for rights holders: to develop and use them or to sell them if they do not need them.”
Landowners are advised to carefully study the new requirements and promptly begin developing their territories to avoid possible sanctions.
