An employee should be paid more for performing the duties of a colleague — a lawyer.

      If an employee performs someone else's duties without being relieved of their primary work, it is legally considered additional work and must be compensated. This was reported to Tatar-inform by Doctor of Law, Honored Lawyer of Russia Lyudmila Aivar. "For this work, an additional payment is mandatory – this is directly stipulated by Article 151 of the Labor Code of the Russian Federation. The amount of the additional payment is determined by the agreement of the parties, taking into account the content and volume of the additional work," Aivar said. If the employee is temporarily transferred to the position of an absent colleague and is relieved of their previous duties, the mechanism of temporary transfer applies. The payment conditions are fixed in official documents – an order or agreement. In such cases, disputes usually concern the correctness of the transfer and payment conditions, rather than the additional payment for combining roles. "Anticipating the question: what happens if the employer does not pay the additional amount? For the employee, this is usually a story about recovering unpaid amounts and monetary compensation for delays/partial payments under Article 236 of the Labor Code of the Russian Federation," the lawyer explained. If the employer does not pay the required additional payment for performing someone else's duties, the employee has the right to contact the Labor Inspectorate or the Prosecutor's Office to protect their rights. An employer who fails to pay an employee for performing someone else's duties faces administrative liability for violating labor legislation (Article 5.27 of the Administrative Offenses Code of the Russian Federation). The amount of the fine depends on the nature and recurrence of the violation.
