Today we will explain how to register property through acquisitive prescription. We have a plot of land. Previously, it was used by my father for more than 15 years. At that time, he did not obtain a certificate of ownership for the land, but he regularly paid land tax. After his death, we continue to use the land plot, but we would like to formally register it in our ownership. Can we do this through acquisitive prescription?

      Svetlana Potapova, acting head of the state registration of real estate department, answers:

      - State registration of a citizen's ownership rights to a land plot provided before the enactment of the Land Code of the Russian Federation on the basis of ownership, lifetime inheritable possession, or permanent (indefinite) use is carried out based on the following documents:

      1) an act of provision of the specified land plot to the citizen, issued by a government authority or a local self-government body;

      2) an act (certificate) of the citizen's right to the specified land plot, issued by an authorized government authority;

      3) an extract from the household book confirming the citizen's right to the specified land plot (if this land plot is provided for personal subsidiary farming), issued by the local self-government body;

      4) another document establishing or certifying the citizen's right to the specified land plot.

      These documents are also required if the act, certificate, or other document establishing or certifying the citizen's right to the specified land plot does not specify the right on the basis of which the specified land plot was provided, or if it is impossible to determine the type of this right.

      If the ownership right to a building (structure) or facility located on this land plot has passed to the citizen by inheritance or other grounds, the following documents may be submitted instead of the document establishing or certifying the citizen's right to this land plot:

      1) a certificate of inheritance rights or another document establishing or certifying ownership rights to the specified building (structure) or facility;

      2) one of the documents establishing or certifying the right of the citizen - any previous owner of the specified building (structure) or facility to this land plot.

      In the absence of a foundational document regarding the land plot, the provision of land plots is carried out by the executive authority of the state or the local self-government body.

      Additionally, we inform you that acquisitive prescription is a legal way to obtain ownership rights to property. A citizen who is not the owner of the property but has honestly, openly, and continuously possessed it as their own for 15 years or more acquires ownership rights to this property (if the actual owner is absent or shows no interest in it).

      Moreover, ownership rights to real estate through acquisitive prescription can be established in court.
