The lawyer explained the procedure to follow in case a tree falls on a car.

      Car owners whose vehicles have been damaged by falling trees should first document all damages and the circumstances of the incident, after which they should seek compensation from their insurance company or the court. This was reported by lawyer Valentina Bachurina, a member of the Union of Lawyer Bloggers based at Kutafin Moscow State Law University under the Association of Lawyers of Russia. She emphasized the importance of gathering as much evidence as possible. "It is important to photograph and video the position of the car, the damages, road signs, address plaques, the surrounding environment, markings, and traces of damage on the tree trunk and the car. The principle here is – the more, the better. Then call the police," Bachurina explained in a conversation with RIA Novosti. According to her, liability for the damage caused is determined in accordance with Article 1064 of the Civil Code of the Russian Federation and is imposed on the organization or individual responsible for maintaining the territory. Thus, if a tree fell in a yard, the management company may be liable, in parks and squares – municipal services, and on private property – its owner. The lawyer added that if there is guilt, for example, if a hazardous tree was not removed in a timely manner, the damage is subject to compensation. Otherwise, the car owner may need to seek compensation through the courts. Bachurina also pointed out insurance nuances: payments may be possible under a CASCO policy, but such cases do not always fall under insurance coverage, and this needs to be clarified in the contract. At the same time, OSAGO does not cover such risks.
