Bailiffs held debtors administratively liable for obstructing enforcement actions.

      The bailiffs of the Aviastroitelny District Department of the Federal Bailiff Service of Russia in the Republic of Tatarstan carried out enforcement actions at the residence of two debtors, the total amount of debt for which under the consolidated enforcement proceedings exceeds 1.2 million rubles.

      During the visit to the residence, a man and a woman, who are debtors under enforcement proceedings, did not open the door for the service employees for a long time. In this regard, the bailiffs took legally prescribed measures of response. After gaining access to the residential premises, the bailiff identified signs of possible violations of the rights and legal interests of the minor children present in the apartment.

      To protect their rights, the information was promptly forwarded to the juvenile affairs department. The arriving PDN employees conducted an inspection and prepared the necessary procedural documents. Further assessment of the identified circumstances and the adoption of appropriate decisions fall under the competence of the authorized bodies. An administrative protocol was drawn up against the citizens for obstructing the lawful requirements of the bailiff, expressed in the failure to provide access for enforcement actions, under Article 17.8 of the Administrative Offenses Code of the Russian Federation "Obstruction of the lawful activities of a bailiff."

      The materials were sent to the magistrate, who imposed an administrative penalty in the form of a fine on the debtors. In addition, a demand for compliance with the requirements of the enforcement document was previously handed to one of the debtors. It was not fulfilled within the established time frame, which led the bailiff to draw up a protocol for an administrative offense under Article 17.14 of the Administrative Offenses Code of the Russian Federation "Violation of legislation on enforcement proceedings." This article provides for liability for non-compliance with the lawful requirements of the bailiff, including for non-compliance with the requirements contained in the enforcement document or the order of an official of the bailiff service.

      The decision to hold the debtors administratively liable under Article 17.14 of the Administrative Offenses Code of the Russian Federation will be made by the bailiff in accordance with the law. The enforcement proceedings continue. The bailiffs are taking a comprehensive set of measures aimed at enforcing the requirements of enforcement documents and protecting the rights and legal interests of citizens within the powers granted by law.
