The editor-in-chief of Za Rulem magazine, Maksim Kadakov, believes that putting drivers under arrest for driving onto tram tracks is too harsh a punishment for such a violation. He shared his opinion with a Tatar-inform correspondent.
Earlier the National Automobile Union (NAU) proposed to punish driving on tram tracks under the article for petty hooliganism, which provides for a fine of 500 rubles or up to 15 days of administrative arrest.
“Of course, this is a debatable question. From a human point of view and from the standpoint of universal justice, this is the right initiative. But is it necessary? If people boast about it: record corresponding videos and post them on social media, then in that case there should be strict prosecution of them, but if someone drove onto the tram tracks by mistake, then I’m not sure that they should be punished so harshly for that. One must distinguish one from the other. Moreover, we have the most humane courts in the world, and 15 days are practically never imposed on anyone. Arrest is generally considered a harsher punishment than license suspension. And such a measure of punishment for driving onto tram tracks will not work either,” the agency’s interlocutor said.
He also noted that punishment for driving onto tram tracks is already provided for in Russia. Thus, according to current legislation, for driving onto tram tracks in the oncoming direction a driver will pay a fine of 5,000 rubles or be deprived of their driving license for 4–6 months. For driving along tram tracks in the same direction and for creating an obstruction to a tram a fine of 500 rubles is prescribed.
