      An expert explained how young Russians can legally get a job.

      Summer vacations are a time when many schoolchildren strive to find their first earnings. Larisa Kirillova, Deputy Dean for Innovative Activities at the Law Faculty of Kazan Federal University, clarified the key aspects of official employment and explained how a civil law contract (CPC) can be dangerous for teenagers. One of the most common questions parents have concerns the age limit for starting a career.

      "According to the general rule established by Article 63 of the Labor Code of the Russian Federation, the conclusion of an employment contract is allowed with individuals who have reached the age of 16. However, the law provides for exceptions. Thus, individuals who have received general education and have reached the age of fifteen can conclude an employment agreement for performing light work that does not harm their health," the specialist explained.

      Larisa Kirillova specified that there are special conditions for those who left educational institutions early.

      "Individuals who have reached the age of fifteen and left a general education organization before obtaining basic general education or were expelled from it and continue to receive general education in another form can conclude an employment contract for performing light work—without detriment to mastering the educational program," the expert emphasized.

      For the employment of 14-year-old citizens, mandatory written consent from legal representatives is required. Younger applicants can also work, but only in strictly defined areas.

      "Up to the age of 14, an employment contract is allowed in film organizations, theaters, theatrical and concert organizations, circuses, but only for participation in the creation and/or performance of works, without harming the health and moral development of the child. For this, the consent of one of the parents (guardian) and permission from the guardianship and custody authority is required," the lawyer reported.

      The working hours of minors are strictly regulated.

      "According to Article 92 of the Labor Code of Russia, for workers under the age of sixteen, the duration of the working week is no more than 24 hours per week. For those aged sixteen to eighteen, it is no more than 35 hours per week. If a teenager combines work with study during the academic year, the duration of working time cannot exceed half of the specified norms. In the case of summer vacations, general reduced norms for minors apply," the Deputy Dean explained.

      In addition to weekly workload, legislation limits the maximum duration of the working day.

      "For those aged fourteen to fifteen, the working day cannot exceed 4 hours; for those aged fifteen to sixteen, it cannot exceed 5 hours; for those aged sixteen to eighteen, it cannot exceed 7 hours," the representative of the law faculty of KFU outlined the relevant requirements.

      For those receiving general education or secondary vocational education and combining education with work during the academic year, these norms are reduced.

      "For those aged fourteen to sixteen, it is 2.5 hours; for those aged sixteen to eighteen, it is 4 hours," she noted.

      The lawyer emphasized that Article 265 of the Labor Code of the Russian Federation lists the areas prohibited for the employment of minors. It is also necessary to know that according to Article 70 of the Labor Code of Russia, a probation period is not established for individuals under eighteen when hiring.

      Most often, employers offer young people to sign not an employment contract but a civil law agreement (CPC).

      "If a teenager is actually working according to an established schedule, performs work functions personally, obeys the internal regulations of the employer, and works under their control, then such relationships have the signs of labor relations, and they should be formalized as an employment contract, not a civil law agreement," the expert emphasized.

      The specialist listed the key dangers that minors face when signing a CPC.

      "The danger is that in this case, the teenager usually loses the labor guarantees provided by the Labor Code of the Russian Federation. In particular, special guarantees for workers under 18 will not apply, including reduced working hours and other restrictions aimed at protecting health. There will be no annual paid leave, and it will be more difficult to prove the right to payment, as under the CPC, the client usually pays for the result of the work, not the fact of showing up for it," the lawyer explained.

      Moreover, when concluding such a contract, the employer often tries to bypass other mandatory requirements, including those related to labor protection and medical examinations of minors.

      "If the civil law agreement has already been signed, but the relationships are actually labor-related, one can seek their recognition as such through the State Labor Inspectorate or the court," concluded Larisa Kirillova.
