The phone is under arrest, the owner is too: how the debtor's escape ended.
In the Mamadysh district department of the Federal Bailiff Service of Russia for the Republic of Tatarstan, there are two enforcement proceedings for the collection of alimony from a local resident. The total amount of debt exceeds 500 thousand rubles.
Back in March 2026, a protocol was drawn up against the citizen for non-payment of alimony under part 1 of article 5.35.1 of the Administrative Offenses Code of the Russian Federation. After reviewing the case materials, the magistrate imposed a penalty of 100 hours of compulsory work. However, the woman never began to serve her sentence, continuing to ignore both the court's decision and her obligation to support her children. Subsequently, another enforcement document for the collection of alimony in favor of another claimant was received by the Mamadysh district department of bailiffs. The bailiffs repeatedly visited the addresses of registration and the presumed residence of the debtor, but she avoided meetings with law enforcement representatives in every possible way.
After a ruling was issued for her compulsory appearance, the officers established the actual whereabouts of the woman. After locating her, she was to be brought to the Mamadysh district department of bailiffs for enforcement actions and the preparation of procedural documents.
However, the debtor decided to act according to her own script. Under the pretext of needing to collect personal belongings, she asked to step out for a moment, after which she attempted to escape. Apparently, the woman thought she could simply run away from her accumulated debts and responsibilities. But practice shows the opposite: you cannot easily escape from a bailiff executing a court decision.
The bailiff from the Department for the Protection of Public Order quickly thwarted the escape attempt. The debtor was detained and brought to the Mamadysh district department of bailiffs.
As a result, three administrative protocols were drawn up against the violator:
- under part 1 of article 5.35.1 of the Administrative Offenses Code of the Russian Federation – for non-payment of alimony under the second enforcement proceeding;
- under part 4 of article 20.25 of the Administrative Offenses Code of the Russian Federation – for evading compulsory work;
- under article 17.8 of the Administrative Offenses Code of the Russian Federation – for obstructing the lawful activities of an official.
In the course of enforcement actions, the bailiff checked the debtor's property status. However, no valuable property that could be seized was found. As a result, a mobile phone belonging to the woman was seized. After reviewing the materials, the magistrate imposed a penalty of 10 days of administrative arrest on the woman. After serving her administrative arrest, the debtor will have to fulfill the previously assigned compulsory work, pay the administrative fine, and begin to repay her alimony debt. In addition, the bailiff explained to her the necessity of finding employment. After her release, she will be issued a referral to the employment center to search for work and fulfill her alimony obligations.
If the debtor continues to evade the support of her children and does not start repaying the debt, administrative measures may be replaced by criminal liability. In this case, she could face prosecution under article 157 of the Criminal Code of the Russian Federation for repeated non-payment of funds for the maintenance of children.
